It has been reported in the press today that Sime Darby has filed civil suit against its former CEO Datuk Seri Ahmad Zubir Murshid and 4 others for RM338 million. It seems from the press reports that Sime Darby did not seek relief for a Mareva Injunction whereby all the movable and immovable assets (i.e. properties, shares, money in the bank accounts and etc) of all the Defendants will be frozen in order to preserve all the assets of the defendants pending the disposal of the said civil suit.

16 December 2010: Minister of Finance II had failed to carry out his promise to table the Sime Darby’s Forensic Reports in Parliament
During the debate on one of the Bills involving Ministry of FInance. I questioned the Deputy Minister of Finance, YB Senator Donald Lim with regards to the Ministry of Finance’s decision to keep the Dime Darby’s Forensic Reports secret. I reminded the said Deputy Minister that the Minister of Finance II, YB Datuk Husni, has promised me in the last session of Parliament that when the Sime Darby Forensic Reports are completed it will be tabled in the House. But the Ministry of Finance had failed to do so.
YB Raja Nong Chik perlu meminta balik diskaun RM36.8 juta demi kepentingan rakyat. Siapakah yang meluluskan diskaun RM36.8 juta?
Update mengenai kes tanah Bukit Kiara terlibat RM36 juta diskaun “diberikan” kepada Sime Darby oleh DBKL!
Pada petang 01 Disember 2010 saya telah membangkitkan masalah-masalah terlibat DBKL dan Kementerian Wilayah Persekutuan dan Kesejeteraan Bandar semasa membahaskan Bajet 2011 peringkat Jawatankuasa di Dewan Rakyat Raykat.
Objektif-objektif utama Kementerian adalah:
- Mempertingkatkan keberkesanan dan kecekapan system penyampaian perkhidmatan melalui pendekatan hands on, mesra rakyat, penggunaan ICT yang meluas dan pewujudan one stop centre;
- Meminimakan masalah kemiskinan di Wilayah Persekutuan melalui program-program yang boleh meningkatkan tahap pendapatan penduduk; dan
- Untuk menggubal, merancang dan melaksanakan dasar-dasar pembangunan fizikal insani berteraskan nilai dan budaya Malaysia untuk menjadikan Wilayah Persekutuan sebagai Bandaraya yang bertaraf dunia.
Sime Darby paid RM40 millions or only RM4 millions to DBKL for the royalty payment for the Bukit Kiara Land?

How about Kuala Lumpur Golf and Country Club (KLGCC) which was occupying a piece of land in Bukit Kiara of about 60 acres which belonging to DBKL for many years? The said piece of land has been used by KLGCC for free for many years and it was was only been paid for by Sime Darby recently for a about RM400 to RM500 millions. Sime Darby had to also pay to DBKL another RM40 millions as some form of royalty payment. I am informed that the actual sum paid to DBKL was only RM4 millions. DBKL gave a “special discount” of RM36 millions! Why?
The Sime Darby’s special audit reports should be tabled in Parliament for scrutiny
Now we hear about Sime Darby will take legal actions by year end to recover the RM2 billion losses due to mismanagement and wrong doings at its energy and utilities divisions. Why wait until year end? Was it another tactic to delay actions? Was it to protect some influential persons?

Saya bangun untuk membahas “Rang Undang-Undang untuk meminda Akta Antipemerdagangan Orang 2007 (Anti-Trafficking in Persons Act 2007),” dengan mengalu-alukan cadangan pindaan.
Tetapi Kerajaan perlu merujuk kepada Laporan “UN High Commissioner for High Commissioner for Human Rights to Economic & Social Council” bertarikh 20 Mei 2002. Iaitu:
The Primacy of Human Rights:
“1. The human rights of trafficked persons shall be at the centre of all efforts to prevent and combat trafficking and to protect, assist and provide redress to victims.
2. States have a responsibility under international law to act with due diligence to prevent trafficking, to investigate and prosecute traffickers and to assist and protect trafficked persons.
3. Anti-trafficking measures shall not adversely affect the human rights and dignity of persons, in particular the rights of those who have been trafficked, and of migrants, internally displaced persons, refugees and asylum-seekers.”

Tuan YB Wee Choo Keong [ Wangsa Maju ] minta Menteri Kewangan menyatakan perincian jumlah kerugian tahunan Sime Darby Bhd dan anak-anak syarikatnya termasuk Golden Hope dan lain-lain sejak dari 1989 hingga 2009 dan tindakan-tindakan yang diambil bagi mengatasi masalah kerugian pada setiap tahun tersebut, mengapa hanya Pengarah Urusan yang diarahkan untuk bercuti kerana lebihan kos (cost overruns) yang melebihi RM1 billion bagi projek elektrik hidro Bakun dan tindakan-tindakan yang telah diambil terhadap mereka yang terbabit menyebabkan lebihan kos (cost overruns) ini sama ada perkara telah dilaporkan kepada MACC dan apakah langkah-langkah yang dikenal pasti bagi mengelak kelemahan pentadbiran yang serupa lagi di Sime Darby.

Skandal Sime Darby
Izinkan saya menyentuh tentang Sime Darby Berhad dan kerugiannya yang kini mencecah 2 billion ringgit.
Kerugian syarikat ini dalam dua projek di Qatar telah bermula pada tahun 2007, tetapi dalam kenyataan-kenyataan akhbar yang di buat oleh pihak syarikat sehingga ke tahun 2009, ianya di nafikan.
Ini bermakna Sime Darby bukan saja membohongi pemegang-pemegang sahamnya, malah ianya telah menipu Suruhanjaya Syarikat Malaysia, Bursa Malaysia dan Suruhanjaya Sekuriti.
Di sini saya ingin bertanya YB Menteri Kewangan apakah tindakan telah diambil oleh Bursa Malaysia dan Suruhanjaya Sekuriti untuk menyiasat skandal Sime Darby.
Saya juga hairan bagaimana Pengerusi Sime Darby Tun Musa Hitam boleh membuat kenyataan bahawa Lembaga Pengarah nya tidak tahu menahu tentang kerugian yang dialami. Ini amat memalukan kerana Sime Darby adalah syarikat perladangan yang terbesar di dunia. Sepatutnya Sime Darby menjadi contoh kepada syarikat lain dalam tadbir urus atau Corporate Governance (dengan izin).
Ini bermakna Sime Darby Berhad mempunyai Lembaga Pengarah yang MATI PUCUK atau IMPOTENT (dengan izin). Ataupun Lembaga Pengarahnya masih tidur bersama dengan pentadbiran Tingkat 4.

Tuan YB Wee Choo Keong [Wangsa Maju] asks the Minister of Home Affairs to state beside recruiting more police officers what action has the Ministry taken to curb the rising crime rate in the country, especially in Wangsa Maju and when the Ministry intend to place more police officer in Wangsa Maju Police Station?
2. Tuan YB Wee Choo Keong [Wangsa Maju] asks the Minister of Transport to state whether his Ministry was aware that AIRASIA (AA) kept the airport tax collected from passengers who were unable to travel, what is the total sum of the airport tax kept by AA and what actions the Ministry will take to make sure that all airport taxes collected by AA to be paid to MAHB without delay?
3. Tuan YB Wee Choo Keong [Wangsa Maju] asks the Minister of Finance to state why it has become the trend that the Inland Revenue Department takes more than a month to refund the excess payment of income tax which is supposed to be refunded within 30 days from the date of application for refund?

Tuan YB Wee Choo Keong [Wangsa Maju] asks the Prime Minister to state what is the definition of the policy of 1Malaysia when the population is still being defined by Bumiputra and Non-Bumiputra and how would the New Economic Model restructure Malaysia to be a just society so that race will no longer be an issue of contention amongst Malaysians?

Tuan YB Wee Choo Keong [Wangsa Maju] asks the Prime Minister to state how can government achieve the 1Malaysia policy in Kuala Lumpur lower courts where all the 22 Magistrates are Malay, out of 23 Session Court Judges an exception 3 Indian and to provide the total number of Magistrates and Session Court Judges of Malay, Chinese, Indian and Others origin throughout the country until June 6, 2010?
More corporations should emulate Sime Darby in engaging bloggers and practising transparency
On Wednesday evening of 25 February 2009, 7 other bloggers and I were invited by Sime Darby Berhad’s Chairman, Tun Musa Hitam, and its President and Group Chief Executive, Dato’ Seri Ahmad Zubir Murshid, to a dinner at its Convention Centre at Bukit Kiara. Head of Corporate Social Responsibilty & Group Communications and Corporate Affairs, Leela Barrock, was also present.
The reason why I was invited was because I was one of the ‘bloggers’ who had been critical of Sime Darby’s involvement in the IJN and LCCT @ Labu issues that ended with the conglomerate abandoning the projects. I also agreed to attend only because I sensed there was sincerity on their part to engage bloggers instead of just having the function as a mere PR exercise to gloss things over.
